Personal and Health Care Services
Coordinate care team (case managers, providers, facilities, etc.)
Liaise with interdisciplinary team (health care, legal, finance, etc.), the family and client for treatment plan or any issues
Maintain open communication with the client and family members, including 24/7 access for emergencies
Review client chart at each visit to ensure adequate medical care
Facilitate/manage contact with friends and family, as needed
Ensure client home visits-frequent, random & scheduled
Analyze Medicare plans to ensure most cost-effective health care plan for client
Advocate in insurance matters, obtaining benefits, policy review
Manage medical and health insurance claims
Act as Agent for Durable Powers of Attorney for Health Care/Advanced Health Care Directive
Manage services such as transport, mobile medical, home bound care
Monitor living arrangements and ongoing care
Facilitate assessment and treatment of chronic medical issues and end of life issues
Fees
Professional Fiduciary rates range from $200-$360 per hour, depending upon the court, size and complexity of the case, assets, or taxes, as well as current or potential litigation and other factors.
For decedent and ongoing trust administrations greater than $2 million, clients may prefer an asset-based fee structure, currently ranging from 0.5% to 1.25%, if undertaken within 6 months. Complex situations may combine asset-based fees plus hourly for unusual/extraordinary services.
Fees payable to the Professional Fiduciary as probate Personal Representative for customary services are authorized under Probate Code §10800 and are computed on a fee base comprised of gross assets, plus receipts and gains, less losses, as follows:
4% of the first $100,000
3% of the next $100,000
2% of the next $800,000
1% of the next $9,000,000
0.5% of the next $15,000,000
Court discretion after $25,000,000
In addition to statutory fees, under Probate Code §10801, extraordinary fees can be requested for services such as tax issues, real property sales and litigation. These fees are subject to court approval in an amount the court determines to be just and reasonable.
